1. 协议范围与接受
本服务条款（以下称「本条款」）是你与 XFMC 软件开发者（以下称「我们」）之间就 XFMC 桌面客户端软件及相关服务（以下称「本服务」）达成的协议。访问 https://xfmc.net/、购买授权码、下载、安装或使用本软件，即表示你已阅读、理解并同意本条款。若你不同意本条款，请勿购买或使用本服务。
2. 服务说明
- 形态：Windows 桌面客户端，面向 TikTok 直播团队与主播。
- 功能：血条对战（标准、攻守、单人、多人）、礼物贴纸、逐位拉票与计时、主播与名单管理、礼物归属统计、场次复盘，以及用于画面呈现的 OBS 浏览器源。
- 商品性质：纯数字商品。官网直销「授权码」，不涉及实物发货、库存或物流，也不需要收货地址。
- 功能以实际版本为准：官网与文档中的说明、截图与演示仅供了解产品；实际功能以你安装并激活的软件版本为准。
3. 授权范围
- 按天数授权：授权码对应你购买的 30 / 90 / 180 / 365 天使用周期。
- 单设备租约：一个授权码在同一时间只能有一台设备处于有效租约内。
- 激活与续期：授权码可用于新设备激活，也可为现有授权续期；续期时长在当前到期时间上顺延。
- 解绑与换绑：我们支持解绑与换绑设备；换绑完成后，原设备立即失去有效租约。
- 使用范围：授权供你本人或你所代表的一个直播团队内部使用，不可转让、不可再许可、不可拆分转售。
- 许可而非出售：本授权是使用许可，我们保留软件本身的一切所有权。

标价以人民币为基准，其他货币按参考汇率换算，仅供参考，实际支付金额以结账页为准。本服务为预付制，不自动续费，我们不会在你未主动下单的情况下扣款。
4. 账号、下单与交付
- 下单：在官网选择使用周期后，进入由 Creem 提供的托管结账页完成支付。
- 交付：支付完成后，系统自动生成与你订单绑定的授权码，并发送到你的后台管理（https://xfmc.net/account.html）与下单邮箱。正常情况下 1 分钟内完成；如超过 24 小时仍未收到，可邮件 support@xfmc.net 申请人工补发。
- 保管义务：请妥善保管授权码与账号凭据。因你主动泄露或共享授权码造成的损失，由你自行承担。
- 信息真实：请使用真实有效的邮箱注册与下单，以便我们完成交付、续期、找回与退款处理。
5. 价格、付款与税费
- 官网标价以人民币为基准价；其他货币金额按参考汇率换算，仅用于展示参考。
- Creem（creem.io）作为 Merchant of Record（记录商户，即法定卖家）处理结账、代收代缴全球税费并处理退款。你在结账页看到的卖家主体为 Creem。
- 本软件开发者是位于中国大陆的独立开发者，服务器位于中国香港。我们不会接触或存储你的完整银行卡信息；卡信息由 Creem 及其支付服务商直接处理。
- 依法应缴的销售税、增值税或类似税费，由 Creem 按其 MoR 安排代收代缴。
6. 退款
退款适用单独的《退款政策》：未激活的授权码在 14 天内可无条件全额退款；已激活但存在无法在合理时间内解决的技术问题，14 天内可退。退款或拒付完成后，授权码立即失效并解绑设备。
7. 可接受使用与禁止行为
使用本服务时，你不得：
- 转售、出租、共享或批量分发授权码、账号或激活凭据；
- 绕过、破解、篡改或以其他方式干扰授权校验、激活、心跳与计费机制；
- 对本软件进行逆向工程、反编译、反汇编，或基于本软件制作衍生作品；
- 将本软件用于任何违法内容或活动，包括但不限于欺诈、赌博、色情、侵犯他人隐私，或违反 TikTok 及适用平台规则的行为；
- 使用自动化手段批量注册账号、恶意下单，或发起虚假拒付；
- 干扰、攻击或试图未经授权访问官网、接口与服务器。
违反上述任一条，我们可暂停或终止你的授权，且已支付费用不予退还。
8. 更新、维护与可用性
- 我们可能不定期发布更新，包含新功能、兼容性修复或功能调整。
- 我们不承诺本服务 100% 无中断或不含错误。官网、激活接口与下载服务可能因维护、升级、网络故障、不可抗力，或第三方平台（含 TikTok、OBS、支付与云服务商）的变更而暂时不可用。
- 我们不对第三方平台的规则、接口或可用性作出任何承诺。因第三方平台变更导致的部分功能不可用，不构成退款理由，但我们会尽合理努力进行适配。
- 我们保留在提前通知后停止维护或停止支持某个旧版本的权利。
9. 你的内容与第三方平台
- 本软件在你的设备上运行，计票与场次数据保存在你的本机。你应对自己导入、处理与输出的内容（含名单、礼物数据与 OBS 画面）及其合法性负责。
- 本软件不是 TikTok 官方产品，与 TikTok 及其关联公司不存在隶属、代理或合作关系。本服务不使用、也不要求你提供 TikTok 账号密码。
10. 知识产权
本软件的代码、界面、文档、商标，以及「流光」「XFMC」名称等，归我们或相关权利人所有。未经书面许可，你不得复制、修改、分发、出租或将其用于任何商业目的。
11. 免责声明
本服务按「现状」和「现有」提供。在法律允许的最大范围内，我们不作任何明示或默示的担保，包括但不限于适销性、特定用途适用性、不侵权，以及不间断或无错误运行的担保。
12. 责任限制
在法律允许的最大范围内，就与本服务有关的任何索赔，我们的累计责任以你在索赔发生前 12 个月内为本服务实际支付的金额为上限。我们不对间接、附带、特殊、惩罚性或后果性损失（包括利润、数据与商誉损失）承担责任。本条款不排除或限制依法不可排除或限制的责任。
13. 暂停与终止
- 你严重违反本条款时，我们可暂停或终止你的授权。
- 你可随时停止使用并卸载本软件；已生效的授权在剩余周期内继续有效（因违规被终止的除外）。
- 终止不影响双方在终止前已产生的权利义务，也不影响知识产权、免责声明、责任限制与准据法条款的效力。
14. 条款变更
我们可更新本条款，并在本页公布新的生效日期。涉及重大变更时，我们会通过官网公告或邮件通知。变更公布后你继续使用本服务，即视为接受变更后的条款。
15. 准据法与争议解决
本条款适用中华人民共和国大陆地区法律（不含冲突规范）。因本条款或本服务产生的争议，双方应先友好协商；协商不成的，提交开发者住所地有管辖权的人民法院解决。

1. Scope and acceptance
These Terms of Service (the "Terms") form an agreement between you and the developer of XFMC (the "Developer", "we", "us") regarding the XFMC desktop client software and related services (the "Service"). By visiting https://xfmc.net/, buying a licence code, downloading, installing or using the software, you confirm that you have read, understood and accepted these Terms. If you do not agree, please do not buy or use the Service.
2. The Service
- Form: a Windows desktop client for TikTok live teams and streamers.
- Features: battle bars (standard, attack/defend, solo, multiplayer), gift stickers, seat-by-seat rally voting and timers, host and roster management, gift attribution statistics, session review, and an OBS browser source used to display the scene.
- Digital goods only: the Service is sold as a licence code directly from this website. There is no physical shipment, no inventory, no logistics and no shipping address required.
- The installed version governs: descriptions, screenshots and demos on this website are provided for information only. The features of the version you install and activate are the features you receive.
3. Licence scope
- Time-based licence: a code corresponds to the 30 / 90 / 180 / 365-day period you purchased.
- One device per lease: a licence code can hold a valid lease on only one device at any given time.
- Activation and renewal: a code can activate a new device or extend an existing licence. A renewal extends the current expiry date.
- Unbinding and rebinding: we support unbinding and rebinding devices. Once a rebind completes, the previous device immediately loses its valid lease.
- Internal use: the licence is for you, or for the single live team you represent. It may not be transferred, sublicensed, split or resold.
- Licence, not a sale: this is a licence to use the software. We retain all ownership of the software itself.

Prices are set in CNY. Amounts in other currencies are converted at reference rates and are indicative only; the checkout page shows the amount actually charged. The Service is prepaid and does not auto-renew; we will not charge you unless you place a new order yourself.
4. Account, ordering and delivery
- Ordering: choose a period on this website and complete payment on the hosted checkout page provided by Creem.
- Delivery: after payment, the system generates a licence code bound to your order and delivers it to your account centre (https://xfmc.net/account.html) and to the email address used for the order. This normally takes under one minute. If you have not received it within 24 hours, email support@xfmc.net for manual re-delivery.
- Keep your code safe: you are responsible for keeping your code and account credentials secure. Losses caused by sharing or disclosing your code are your own responsibility.
- Accurate details: please register and order with a valid email address so that we can handle delivery, renewal, recovery and refunds.
5. Prices, payment and taxes
- List prices are set in CNY. Amounts in other currencies are converted at reference rates for display only.
- Creem (creem.io) acts as the Merchant of Record, meaning it is the legal seller for the transaction: it handles checkout, collects and remits applicable taxes worldwide, and processes refunds. The seller you see at checkout is Creem.
- The developer of this software is an independent developer based in mainland China, and the servers are located in Hong Kong. We never receive or store your full card details; card data is handled directly by Creem and its payment providers.
- Any sales tax, VAT or similar tax due is collected and remitted by Creem under its Merchant of Record arrangement.
6. Refunds
Refunds are governed by our separate Refund Policy: an unactivated licence code can be refunded in full with no questions asked within 14 days; an activated licence can be refunded within 14 days if there is a technical problem we cannot resolve within a reasonable time. Once a refund or chargeback is completed, the licence code is invalidated immediately and the device is unbound.
7. Acceptable use and prohibited conduct
When using the Service you must not:
- resell, rent, share or bulk-distribute licence codes, accounts or activation credentials;
- bypass, crack, tamper with or otherwise interfere with licence verification, activation, heartbeat or billing mechanisms;
- reverse engineer, decompile or disassemble the software, or create derivative works based on it;
- use the software for any unlawful content or activity, including fraud, gambling, pornography, invasion of privacy, or conduct that violates TikTok or other applicable platform rules;
- use automation to mass-register accounts, place malicious orders, or file fraudulent chargebacks;
- interfere with, attack, or attempt unauthorised access to this website, its APIs or its servers.
If you breach any of the above, we may suspend or terminate your licence without refund.
8. Updates, maintenance and availability
- We may release updates from time to time, including new features, compatibility fixes or changes to existing features.
- We do not promise that the Service will be uninterrupted or error-free. This website, the activation API and downloads may be temporarily unavailable due to maintenance, upgrades, network failures, force majeure, or changes made by third-party platforms (including TikTok, OBS, payment and cloud providers).
- We make no commitment regarding the rules, APIs or availability of third-party platforms. Features that become unavailable because a platform changed are not grounds for a refund, although we will make reasonable efforts to adapt.
- We reserve the right to end maintenance or support for an older version after giving notice.
9. Your content and third-party platforms
- The software runs on your device, and tally and session data are stored locally on your machine. You are responsible for the content you import, process and output (including rosters, gift data and OBS scenes) and for its lawfulness.
- This software is not an official TikTok product and is not affiliated with, authorised by or acting as an agent of TikTok or its affiliates. The Service does not use, and never asks you for, your TikTok account password.
10. Intellectual property
The software code, interface, documentation and trademarks, together with the names "流光" and "XFMC", belong to us or to the relevant rights holders. Without our written permission you may not copy, modify, distribute, rent or otherwise use them commercially.
11. Disclaimer of warranties
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we make no express or implied warranties, including any warranty of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.
12. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service is limited to the amount you actually paid for the Service in the 12 months before the claim arose. We are not liable for indirect, incidental, special, punitive or consequential damages, including lost profits, lost data or loss of goodwill. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
13. Suspension and termination
- We may suspend or terminate your licence if you materially breach these Terms.
- You may stop using the software and uninstall it at any time; a valid licence remains usable for the remainder of its period unless it was terminated for breach.
- Termination does not affect rights and obligations that arose before termination, nor the continued effect of the intellectual property, disclaimer, limitation of liability and governing law sections.
14. Changes to these Terms
We may update these Terms and publish a new effective date on this page. For material changes we will post a notice on this website or email you. Continuing to use the Service after a change takes effect means you accept the revised Terms.
15. Governing law and dispute resolution
These Terms are governed by the laws of mainland China, excluding its conflict-of-law rules. The parties will first try to resolve any dispute arising from these Terms or the Service in good faith through negotiation. If negotiation fails, the dispute will be submitted to the competent people's court at the Developer's domicile.
